1. Scope and acceptance
By creating an account, accepting an invitation, accessing the Optiroom workspace, or otherwise using the service, you agree to these Terms & Conditions on behalf of yourself and, where applicable, the company or organization you represent.
If you are using Optiroom for a company, brokerage, or other organization, you confirm that you have authority to bind that organization to these terms. If you do not agree, do not use the service.
2. Service description
Optiroom is a production-oriented software platform for real-estate listing media workflows. It may include room-emptying, image enhancement, review, approvals, exports, website widgets, billing, notifications, and administrative controls.
We may improve, refine, suspend, or retire features from time to time where reasonably necessary for security, compliance, reliability, or product evolution.
3. Eligibility and account security
You must provide accurate registration information and keep it up to date. You are responsible for all activity under your account, workspace credentials, and invited team seats.
You must maintain appropriate password hygiene, keep verification methods secure, and notify us promptly if you suspect unauthorized access, loss of credentials, or misuse of your workspace.
- Do not share credentials outside authorized team use.
- Do not attempt to bypass access controls or rate limits.
- Do not use Optiroom in a way that risks harm to the service or other customers.
4. Workspace, teams, and customer responsibilities
Workspace owners and admins are responsible for assigning appropriate roles, reviewing team access, and ensuring uploads, exports, and approvals are handled in line with their own client obligations and internal processes.
You remain responsible for the business decisions you make using Optiroom, including whether to publish, export, share, or rely on any processed or AI-assisted output.
5. Customer content and rights
You retain ownership of the images, branding, instructions, and other material you upload or submit to Optiroom. You grant us the limited rights needed to host, process, transmit, secure, back up, and display that content for the purpose of operating the service for you.
You represent and warrant that you have all rights, permissions, and legal bases needed to upload and process your content, including any necessary rights from photographers, agencies, property owners, tenants, or third parties.
6. Acceptable use
You may not use Optiroom for unlawful, misleading, infringing, or abusive purposes. You may not upload content that you do not have the right to use, or use the service to violate privacy, intellectual-property rights, or contractual duties owed to others.
- No reverse engineering, scraping, or automated extraction beyond explicitly permitted API use.
- No attempts to interfere with infrastructure, availability, or other customers' workspaces.
- No use of the service to generate deceptive or unlawful property marketing materials.
7. AI-assisted and processed outputs
Optiroom may provide deterministic processing and AI-assisted features. Processed outputs can support real-estate marketing workflows, but they are not a substitute for your own editorial judgment, compliance review, or factual accuracy checks.
You are responsible for reviewing outputs before publication, export, or delivery, especially where marketing, listing compliance, consumer law, or disclosure obligations apply.
8. Billing, subscriptions, and credits
Paid features may be offered on a subscription and/or credit basis. Prices, billing terms, renewal behavior, and included allowances will be presented at checkout or within the applicable billing interface.
Credits are consumed when eligible actions run. Except where required by law or expressly stated otherwise, purchased credits are non-refundable once applied or made available. We may issue credits, reversals, or compensation in cases such as failed runs, billing corrections, or support remediation.
9. Availability and support
We aim to provide a reliable service, but Optiroom is offered on an as-available basis. Scheduled maintenance, security measures, infrastructure incidents, provider dependencies, and force majeure events may affect availability from time to time.
Any support times, onboarding guidance, or service expectations are operational targets unless separately agreed in writing.
10. Intellectual property
Optiroom, its software, documentation, workflow design, branding, and non-customer materials are protected by intellectual-property laws and remain the property of Aveniro SL or its licensors.
Except for the limited rights expressly granted to use the service, no license or transfer of ownership is granted.
11. Suspension and termination
We may suspend or restrict access where reasonably necessary to address security concerns, non-payment, unlawful use, repeated policy breaches, or material misuse of the service.
You may stop using Optiroom at any time. Termination does not affect rights or obligations that accrued before termination, including payment obligations, confidentiality duties, and limitations of liability.
12. Warranties disclaimer
To the maximum extent permitted by law, Optiroom is provided without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
We do not warrant that outputs will always be error-free, suitable for every listing, or accepted by every marketplace, MLS, portal, or downstream workflow.
13. Liability
To the maximum extent permitted by law, Aveniro SL will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, business, goodwill, anticipated savings, or data.
Our aggregate liability arising out of or related to Optiroom will not exceed the total fees paid by the relevant customer for the service during the twelve months preceding the event giving rise to the claim, except where liability cannot be limited under applicable law.
14. Changes to these terms
We may update these Terms & Conditions from time to time to reflect product, legal, security, or operational changes. The updated version becomes effective when posted, unless a later effective date is stated.
Where changes materially affect your rights or obligations, we will take reasonable steps to notify active customers through the website, workspace, or account contact details.
15. Governing law and venue
These Terms & Conditions are governed by the laws of Spain, excluding conflict-of-laws rules, unless mandatory law requires otherwise.
Unless applicable law provides otherwise, disputes arising from or related to the service will be submitted to the competent courts of Alicante, Spain.
